Justice Denied... No More?

Yesterday, legal observers across the nation were stunned. This was far from expected.

In a Florida courtroom, Michael Dunn was found guilty of the first degree murder of Jordan Davis. The jury had deadlocked on this charge during the original trial, though they ultimately agreed to convict Dunn of attempting to murder the other passengers in the car Dunn had shot into due to a dispute over "loud music". But this time, the jury only took 6 hours to reach a verdict.



Like George Zimmerman, Michael Dunn used Florida's "Stand Your Ground" statute as his legal defense. Ever since the NRA and ALEC began promoting "'Stand Your Ground' model legislation" across the nation, more of these cases have popped up in the states that have adopted this "model legislation". We even have a "Stand Your Ground" case right here in Nevada, as Wayne Burgarello is using AB 321 as his legal defense in his murder trial in Reno.

Wayne Burgarello's next court date is set for October 15. He's been released on $150,000 bail. And he's plead not guilty in the murder of Cody Devine and the attempted murder of another woman at Burgarello's abandoned duplex. Burgarello claims he "stood his ground against trespassers", but Devine's family members say Cody didn't even know the duplex he & his female friend were staying in was Burgarello's.

Many have been wondering how difficult it may be for the Washoe County District Attorney's Office to convict Burgarello, especially considering the "ace in the hole" he has in AB 321. But now that a Florida jury has convicted Michael Dunn for murdering Jordan Davis despite "Stand Your Ground", perhaps there's reason for Cody Devine's family to continue hoping for justice here in Nevada.



Still, it's concerning to realize how difficult it is to prosecute murder cases in Florida, in Nevada, and in other "Stand Your Ground" states. It's hard for us to understand how George Zimmerman, Michael Dunn, or Wayne Burgarello to claim "self defense" in any other capacity. Perhaps the outcome of the Burgarello trial will be more like Dunn's and less like Zimmerman's. Or perhaps, the reverse will be true.

Regardless, we will likely see more AB 321/"Stand Your Ground" cases as time marches on. And going forward, the question for Governor Brian Sandoval (R-NRA) and the Nevada Legislature will be: "Did you agree to 'model legislation' that just let someone get away with murder"?

Still Standing on Troubled Ground

(This series has pretty much become our default 5 year anniversary commemoration. And in light of the latest Zimmerman family news gracing all the nation's finest tabloid outlets [along with more reputable outlets], we want to remind everyone of why we must endure this nonsense. So let's step back to July 2013 and remember why George Zimmerman is allowed to embarrass himself in front of the media cameras while the Martin family still mourn over justice denied.)

On Saturday, a Florida jury acquitted George Zimmerman for the killing of Trayvon Martin. Since the verdict was announced, protests have broken out nationwide.

Thousands of demonstrators from across the country — chanting, praying and even fighting tears — protested a jury’s decision to clear neighborhood watch volunteer George Zimmerman in the shooting death of an unarmed black teenager while the Justice Department considered whether to file criminal civil rights charges. [...]

The NAACP and protesters called for federal civil rights charges against Zimmerman, who was acquitted Saturday in Martin’s February 2012 shooting death. The Justice Department said it is looking into the case to determine whether federal prosecutors should file criminal civil rights charges now that Zimmerman has been acquitted in the state case. The department opened an investigation into Martin’s death last year but stepped aside to allow the state prosecution to proceed. [...]

In Miami, more than 200 people gathered for a vigil. “You can’t justify murder,” read one poster. Another read “Don’t worry about more riots. Worry about more Zimmermans.” Carol Reitner, 76, of Miami, said she heard about the vigil through an announcement at her church Sunday morning. “I was really devastated. It’s really hard to believe that someone can take the life of someone else and walk out of court free,” she said. [...]

In Philadelphia, about 700 protesters marched from LOVE Park to the Liberty Bell, alternating between chanting Trayvon Martin’s name and “No justice, no peace!”

“We hope this will begin a movement to end discrimination against young black men,” said Johnathan Cooper, one of the protest’s organizers. “And also to empower black people and get them involved in the system.”



A young man was gunned down for walking outside while black. He was carrying Arizona iced tea and Skittles. And he was wearing a hoodie. This is what George Zimmerman found "threatening".

Somehow, a jury of six in Sanford, Florida, found Zimmerman's story possible. So they acquitted him. And protests have since spontaneously emerged nationwide. When is the slaughter of an innocent teenager justified?

That's what continues to be asked in Florida and nationwide. When did the victim become the suspect? When did racial profiling become "public safety"? Why is this happening?

Not only have the NRA, ALEC, and the rest of "Tea Party, Inc." succeeded in recent years in making so many dangerous weapons readily accessible (even to criminals), but they have also passed "Stand Your Ground" laws across the country (including a limited version here in Nevada) that encourage the very vigilantism that George Zimmerman engaged in. And on top of that, these "Stand Your Ground" laws allow vigilantes like Zimmerman to walk away free after shooting innocent people.

So where do we go from here? What happened over the weekend served as a stark reminder of the many loopholes in our gun laws... And of the long road ahead to remedy continuing racial discrimination across this country.

What Boobs

They still haven't learned. And no, not even an entire online TV channel can save the fine folks at the NRA from their own insani-TEA. Hell, not even an entire online TV channel can save the NRA (and its BFF Open Carry Texas) from an army of topless women armed with "boobs for peace"!



But wait, there's more. Not wanting to be outdone by a bunch of ragtag Texas women daring to "bare it all", the NRA decided to go Godwin.

Oh, yes. That's right. An NRA lobbyist Brian Judy actually compared expansion of background checks to the genocidal tyranny of Nazi Germany. Wait, what?!

The NRA and its "TEA" powered allies in Washington State are furious over Seattle venture capitalist Nick Hanauer supporting I-594. So not only did the NRA decide to engage in "Everyone gets a gun!" style socialism, but one of its Washington lobbyists actually attacked Hanauer, his Jewish heritage. And then, he claimed Hanauer is trying to disarm the proletariat, provoke Helter Skelter, and celebrate his family's escape from Nazi Germany by endorsing the alleged policies that would have exterminated them.



Wait, what?! We know the NRA is trying hard to "rebrand" itself as "the nation's oldest civil rights organization", but this is just beyond the pale. It was bad enough when the NRA celebrated George Zimmerman's ruthless slaughter of Trayvon Martin. It only worsened when the NRA then encouraged Cliven Bundy and his "Patriot Movement" comrades to start a "Range War" in Bunkerville. And it only became more tragically revolting when the NRA's favorite G-O-TEA politicians boasted about being "what stood in the way" of mere background checks legislation (like Washington's I-594) that could have prevented Jerad & Amanda Miller from obtaining the weapons they needed to slaughter two Las Vegas Metro police officers and one civilian in June.

Those women in Austin may have revealed their bare breasts as a response to ammosexual idiocy, but the NRA and its allies seem to be the real boobs here. Either they're incredibly clueless about their own "legacy of civil rights", or they're attempting to be "too clever by half" by adopting this rhetoric. Either way, they sound like idiots. Either way, they're the ultimate boobs.

Bloody "Rebranding"

We know they like to go there. But really, must they go there? Don't they realize how moronic they sound whenever they go there?

But alas, NRA "News" internet eye candy commentator Dom Raso insists on going there.



Really, Mr. Raso? Really, NRA? Jim Crow? Seriously?

We know the NRA is trying hard to "rebrand" itself as "the nation's leading civil rights organization"... But that doesn't mean this statement is true. After all, where was the NRA when Trayvon Martin was brutally murdered?



Oh, yes. That's right. The NRA was busy enabling more George Zimmermans to "stand their ground" against innocent people. And the NRA & its "TEA" tinged allies were busy attacking Trayvon's family & friends for daring to fight for #JusticeForTrayvon.

And for the record, we saw the same reaction from the NRA after the murder of Jordan Davis. That's because the NRA always turns to "philosophical arguments" over "framing & language" whenever it's confronted with the ugly truth about "Stand Your Ground".



Jim Crow? Seriously? But of course, it's easier for the NRA to turn to rhetorical nonsense than to address its own history of enabling the likes of Johnny Lee Wicks, Cliven Bundy, Wayne Burgarello, Jerad & Amanda Miller, and Brent Douglas Cole. The NRA can "rebrand" itself as often as it wants, but it can't "rebrand" away its own bloody record.

Mack the Gun

We know 2006 may seem like an eternity ago, but please pay attention. And please do join us on this little stroll down Memory Lane.

In 2006, Darren Mack was undergoing a bitter divorce with his soon-to-be-ex-wife, Charla. He was incensed when Washoe County Family Court Judge Chuck Weller ordered Darren to pay Charla $10,000 per month in spousal support in addition to $849 per month in child support. He didn't like Judge Weller's ruling, so Darren Mack responded by "standing his ground". He stabbed Charla to death, then he shot Weller in a sniper style attack.



Even though Darren Mack ultimately plead guilty to the murder of Charla and attempted murder of Judge Weller at a Las Vegas courthouse in 2007, he later recanted his guilty plea. And even though the Nevada Supreme Court ultimately rejected his appeal, Darren Mack is trying again. And wait for this, he believed he was justified in shooting who he saw as a "corrupt judge" and exercising "self defense" against his wife.

Sound familiar yet? During the murder trial, state & national media shined a spotlight on the heinous nature of Mack's crimes. Even today, one can find shows on cable TV detailing every lurid and horrid aspect of the Mack case. Yet now, it doesn't seem that extraordinary. It doesn't seem all that far-fetched. It doesn't seem all that shocking.

Since Darren Mack's name and face were splashed all over the front pages in Las Vegas & Reno, we've seen the rise of the "Stand Your Ground" Doctrine that can at least theoretically be used to justify Darren Mack's crimes. Hey, Wayne Burgarello went ahead and "stood his ground" against someone who didn't even know he was trespassing. And Johnny Lee Wicks "stood his ground" against a US Marshal and a courthouse security officer who had nothing to do with his denied Social Security claim. (And even if they did, was that shooting really justified?)

We've also seen the rise of Cliven Bundy and "TEA" powered "Range War" against state & federal law. Because the Bundy Gang don't like civil society, they think they can unilaterally impose armed madness upon everyone else.



And of course, this has aided the rise of "sovereign citizen" and "Patriot Movement" violence. Up north, Brent Douglas Cole opened fire on law enforcement agents on federal land. Down south, Jerad & Amanda Miller shot dead two Metro Police Officers and a civilian at a Las Vegas strip mall. And in other parts of the nation, "sovereign citizens" have sought armed conflict with the law... Because all of them refuse to acknowledge the legitimacy of our nation of laws.

We can't help but wonder if Darren Mack has been noticing recent events. Back in 2006, and even in 2008, his crimes were almost universally condemned. But now, we have an entire "movement" of "patriots" and "sovereign citizens" who champion the kind of crimes Darren Mack committed. And we have the NRA backing them up. And we even have a number of G-O-TEA politicians standing in the way of any effort to rein in the gun violence these extremists regularly partake in.

While Darren Mack's latest appeal doesn't seem likely to succeed, it's frightening to think he even has a tiny opening today. And he has the "sovereign revolutionaries", their cheerleaders at the NRA, and their ideological soulmates to thank for this.

Standing on What Ground?

How could we have known? Sooner or later, this kind of tragedy was bound to happen. And now, we're bound to witness a hot mess explode in court... Even though it's crystal clear that Wayne Burgarello shot two people.

So why is this bound to be a hot mess? Wayne Burgarello admitted he shot Cody Devine dead and seriously wounded Janai Wilson. What else do we need to know? Ah, but Wayne Burgarello is now claiming "Stand Your Ground" as his legal defense.



Wait, what?! Remember when the Nevada Legislature passed AB 321 in 2011? We do. Oh, and we remember sounding this alarm in 2012.

They set up a dangerous slippery slope for justifying as "self-defense" what would otherwise be declared manslaughter or murder. After all, what we may consider murder can be twisted by a smart criminal defense attorney into a "Stand Your Ground" situation just by insinuating that the homicide victim was somehow threatening the shooter's life and/or property, even if there's little or no evidence that the shooter was really at risk.

So why are we now falling down this slippery slope? Why did we have to take this downhill course in the first place? And can we afford to keep making decisions out of political convenience while ignoring future public safety crises?

And this is exactly what Wayne Burgarello's defense attorney is claiming. He's claiming Burgarello had the right to shoot Cody Devine and Janai Wilson because he found them at his vacant duplex in Sparks. After all, isn't this what "Stand Your Ground" is for?

Ever since George Zimmerman was set free after murdering Trayvon Martin, we've had to confront this brutal reality. Zimmerman shot Martin dead for "committing the crime" of walking outside while black. Martin was "armed" with a hoodie, a bag of Skittles, and a bottle of Arizona iced tea. And yet, George Zimmerman now enjoys his G-O-TEA/"gun enthusiast" celebrity status while Trayvon Martin's family must go to the cemetery to visit him.

But wait, wasn't Cody Devine trespassing upon someone else's property? Possibly, though it's unclear as to whether he even knew he was not wanted there. Whatever the case, did Wayne Burgarello have the right to unilaterally impose the death penalty on him?

This is the central question to the "Stand Your Ground"/Shoot to Kill principle. Should anyone have the ability to unilaterally impose the death penalty on someone else for whatever reason? Do we really need to return to the "Old West Days" of shootouts anywhere, everywhere? Why did the Nevada Legislature & Governor Brian Sandoval (R) approve this? Might they be having second thoughts about this now?

Standing on Ugly Ground

We tried to warn everyone. We took notice when Cliven Bundy invited Richard Mack and other shady (& rather dangerous) characters to #BundyRanch. And we couldn't mince words when we saw G-O-TEA politicians like Dean Heller, Michele Fiore, & Cresent Hardy rush to Bundy's side.

Even though it was painfully obvious that Cliven Bundy broke the law, G-O-TEA politicians & pundits from across the nation were rushing to #BundyRanch to proclaim "FREEDOM!!!" from the rule of law. It's been embarrassing for all of us here in Nevada to witness. And we're sure it's given the rest of the nation further reason to wonder what the hell is going on in The Silver State.

But now, the level of crazy at #BundyRanch has risen to a whole new level. Cliven Bundy recently did an interview with The New York Times' Adam Nagourney. And now, we're becoming more familiar with Bundy's views on American society in general.



Even prominent conservative curmudgeons like MSNBC's Joe Scarborough have asked Republican politicians to back away from #BundyRanch. And so far, Rand Paul has taken his advice. However, Rick Perry is now trying to have it both ways on Bundy. G-O-TEA media personalities like Dana Loesch continue to make excuses for Bundy. And National Review writer Kevin Williamson still wants to compare the Bundy Gang to Mahatma Gandhi and "the heroes of The Alamo".

Wait, haven't we seen this before? Haven't we seen G-O-TEA politicians & pundits rush to the defense of someone who wanted to "Stand Your Ground"?

Oh, yes. That's right. Around this time last year, G-O-TEA Culture Warriors were hailing George Zimmerman as a "hero" because he "stood his ground" against Trayvon Martin. After all, Martin posed such a dangerous threat with his hoodie, that bag of Skittles, and that bottle of Arizona iced tea.

Earlier this week, MSNBC's Chris Hayes & Michael Eric Dyson discussed how #BundyRanch would be different if there were African-Americans resisting police at an urban or suburban "ranch". Think about it.



Remember that Trayvon Martin and Jordan Davis never actually resisted police. They didn't even break the law when they were shot dead. They just happened to be in the wrong place at the wrong time. They just happened to be confronted by white men with vigilante fantasies dancing in their heads. And only one of those white men actually faced any sort of penalty for taking an innocent life.

The NRA & the gun industry have fought hard over the years to expand "Stand Your Ground" to Nevada and numerous other states. We're seeing the consequences of this unfold before us now. While innocent people lose their lives because of how "threatening" they look, actual outlaws claim the law is on their side because they have the "right to stand their ground" against such things as federal law.



We tried to warn everyone. We suspected we were standing on some very ugly & unstable ground. We've been allowing the NRA to rewrite the rules on "acceptable use of force". And this is the result. "Welfare King" Cliven Bundy can gleefully "stand his ground" while Trayvon Martin & Jordan Davis lose their lives.

"Second Amendment Remedies"

Last Saturday, Americans across this nation were shocked to witness the violence that broke out in Bunkerville over the BLM's attempt to rein in Cliven Bundy's illegal Gold Butte cattle run & tax evasion scheme. Apparently, it's not enough that Bundy's family has benefited from so much "big government welfare" for over 100 years. He's also wanted "legal recognition" to violate federal law with reckless abandon. And last weekend, he brought in some "TEA" drinking friends from other parts of the nation to provoke armed conflict with federal public servants.

Even though the BLM operation has been discontinued for now, the law will eventually catch up with this lawless bunch. Bundy & his "TEA" powered allies may face federal criminal charges for their attempt at provoking insurrection.

But of course, the wannabe #BundyRanch insurrectionists don't see it that way. They claim they're just taking advantage of what Sharron Angle (in)famously referred to as "Second Amendment Remedies".



And they're not the only ones who have been "going there" recently. Frazier Glenn Miller also resorted to "Second Amendment Remedies" when he opened fire on a Jewish community center & retirement village in Overland Park, Kansas, yesterday. The longtime white supremacist/Ku Klux Klan/neo-Nazi leader shot 3 people dead before police arrested him.



Once again, we're reminded of something evil in our society. Once again, we're reminded of what happens when we encounter a "bad guy with a gun". And once again, we're reminded of the lengths the NRA and the rest of the gun lobby will go to maximize their profits.

Are G-O-TEA politicians here in Nevada and elsewhere still proud of being "what stood in the way" between us and saner gun laws? Do they actually believe the bile filled rhetoric they spew when they praise Cliven Bundy's "Second Amendment Remedies"? Do they truly favor the ability of criminals like Frazier Glenn Miller to easily access dangerous firearms?

Think about it. What we saw this past weekend in Bunkerville and in Overland Park was the logical conclusion of "Second Amendment Remedies". And that should make us all remember what makes a civilized society (and what can tear one down).

Standing on Dangerous Ground

Today marks a tragic anniversary. Today marks the second anniversary of the untimely death of Trayvon Martin. Two years ago, George Zimmerman decided to try, convict, and execute Martin for the "crime" of walking outside while black... And Zimmerman then literally got away with murder.



He was able to do so thanks to Florida's "Stand Your Ground" statute. This statute came into being thanks to the aggressive lobbying of the NRA, the (rest of the) gun industry, and their shady "TEA Party, Inc." allies. And they've managed to spread "Stand Your Ground" beyond Florida.

Believe it or not, even Nevada has a somewhat milder version of "Stand Your Ground" on the books thanks to the stranglehold the NRA and its "TEA" powered allies have over Carson City. Just like the "license to discriminate" legislative franchise, "Stand Your Ground" was cooked up in the back rooms of "TEA Party, Inc.", then quickly exported across the nation.

Yet unlike the "license to discriminate" bills sweeping across the nation, the "Stand Your Ground" bills have already been becoming law. And they've already been claiming lives. We're now quite familiar with the horrifying death of Trayvon Martin. More recently, we've witnessed the aftermath of Jordan Davis' untimely passing. And just last month, we learned about the slaying of Chad Oulson... Over texts to his 3 year old daughter's babysitter before a movie. All of these deaths were untimely and unnecessary, yet they all occurred because the respective perpetrators claimed "Stand Your Ground" as a legal defense.

Sadly, this is what happens when we allow a handful of well heeled corporate interests to hijack our legislative system and turn it into their own policy laboratory. We're now uncovering the dangerous consequences of this practice. And as long as the likes of the NRA, ALEC, & other shadowy "TEA" fueled groups continue to call the shots in the halls of power, we will only see more lives lost over this nonsense.

When Florida legislators got the ball rolling on "Stand Your Ground", they thought they were just "helping those who are trying to defend themselves". We're sure Nevada legislators felt the same way when they passed the Nevada version of "Stand Your Ground". What they failed to realize is that they didn't actually do that. Rather, they opened a "Pandora's Box" full of danger. It remains to be seen how many more lives must be lost before we can retreat from this dangerous ground we stand on.

What Stood in the Way

Here they go again. Once more, "Republican rebranding" is the term of the day. Why? They just can't stop reminding us of why they tried "rebranding" in the first place.

Case in point: Colorado State Senator Bernie Herpin (R-Colorado Springs). While the Colorado Legislature was debating a bill he proposed to overturn the state’s new ban on high capacity magazines, he let these "words of wisdom" slip from his tongue.

“My understanding is that James Holmes bought his 100-round capacity magazine legally,” state Sen. Irene Aguilar (D) said to Herpin during the hearing. “So in fact, this law would have stopped James Holmes from purchasing a 100-round magazine. ... I just wondered if you agree with me.”

“Perhaps, James Holmes would not have been able to purchase a 100-round magazine,” Herpin said in response. “As it turned out, that was maybe a good thing that he had a 100-round magazine, because it jammed. If he had instead had four, five, six 15-round magazines, no telling how much damage he could have done until a good guy with a gun showed up.”

For the record, James Holmes was able to shoot 45 rounds in that Aurora movie theater in July 2012. He killed 12 people and wounded 58 others. And NRA All Star Bernie Herpin thinks it's "maybe a good thing" that James Holmes was able to legally obtain a 100-round magazine to use to kill 12 people & injure 58 other people in that Aurora movie theater?

Meanwhile in Florida, the NRA & its G-O-TEA allies are pushing to expand Florida's now infamous "Stand Your Ground" statute. Michael Dunn is on trial for the murder of Jordan Davis. And even though Dunn is using "Stand Your Ground" as his defense, his supporters are worried that his story of "defending himself against a car blasting loud music" may simply be too absurd for a jury to use to acquit him of all criminal charges. So now, the NRA is "jumping to the rescue" to save white & well armed wannabe militia-men from the "clear & present danger" of unarmed African-American youth like Jordan Davis & Trayvon Martin.

Meanwhile here in Nevada, some local Republicans want everyone to know that Governor Brian Sandoval (R-NRA) is "what stood in the way" between us and better gun safety laws. It probably won't be long until we hear about how US Senator Dean Heller (R-NRA) & Rep. Joe Heck (R-NRA) are "what stood in the way" between us and federal level progress on gun violence prevention. After all, why shouldn't they all be proud of standing in the way of efforts to prevent the meaningless loss of life of those who simply "committed the crime" of going to the movies, listening to music in the car, going to school, and/or walking home while black?

Yep, so many G-O-TEA politicians continue to boast about how they're "what stood in the way" of any & all gun safety legislation. And they continue deluding themselves into thinking this is some kind of "virtue".

"It's All Business"

Is it just us, or does it seem like we've seen quite a bit of weird celebrity news lately? Justin Bieber may be deported. Bill Nye had to debate the movement to nullify the entire 20th & 21st centuries. And J.K. Rowling now wants to change the end of her own damned Harry Potter story.

My gawd, what is this world coming to? Wait, what?! DMX agreed to a boxing match against George Zimmerman? WTF?!

Not so fast. Damon Feldman, the organizer of this pay-per-view clusterfuck match, has a history of promoting staged celebrity fights and cashing in on the fakery of it all. So don't get too thrilled about DMX getting "vigilante" on Zimmerman's ass.

And really, don't feed this kind of trollish assholery. This won't bring back Trayvon Martin. And it won't bring anyone any kind of justice.

You know what will? Repealing the warped "Stand Your Ground" statutes that let George Zimmerman off the hook for shooting an unarmed, innocent human being.

While watching DMX "beat the living fuck" out of Zimmerman may seem satisfying, it won't lessen the scourge of rampant gun violence in America. That will only come with loosening the NRA's & gun industry's extreme stranglehold over our political system in DC & close to home.

When asked why he'd put on such a lurid show, Damon Feldman replied, "It's all business." Apparently, the gun industry and its apologists on Capitol Hill (and in Carson City, for that matter) feel the same way. "It's all business." It's just too bad for all the rest of us that their "business" is not just classless, but downright deadly.

The Dream Still Lives (Despite Recent Nightmares).

Last Saturday, we reflected on the upcoming 50th anniversary of Dr. Martin Luther King Jr.'s "I Have a Dream" speech. We remembered how much our nation has grown since then. We also noticed what still needs to be done to achieve Dr. King's dream.

Today, the latter is becoming even more painfully obvious. For one, the usual G-O-TEA suspects continue to race-bait the already tragic shooting death of Chris Lane, the Australian student and baseball player attending a college in Oklahoma. He was allegedly gunned down by "three bored teens". Yet while Australian media have zeroed in on our dangerously violent culture and incredibly lax gun laws, right-wing media here are twisting facts and building up tension in a desperate attempt to prove "Reverse Racism!!! White people under attack!!!"

And that's not all. Just over a month after his acquittal in the Trayvon Martin murder trial, George Zimmerman took his "victory tour" to the very factory that produced the gun he used to kill Trayvon Martin. No, I'm not even kidding.

Part of what made the Zimmerman acquittal hard to take was the shooter’s utter lack of remorse for killing Martin. Even if you believed every word of his self-defense claim, it had to be hard to imagine having no regrets about the death of a teenager. Even Sean Hannity, who normally appears conscience free, asked Zimmerman if he had “regrets” about getting out of his car and following Martin, which led to their confrontation and the boy’s shooting. “It was all God’s plan, and for me to second guess it or judge it,” Zimmerman told Hannity, his voice trailing off.

That’s the kind of cluelessness that would lead a guy to tour the factory that made the gun he used to kill Martin, and to pose grinning with a star-struck factory worker like he’s Frank Sinatra visiting a local trattoria.

It’s particularly sad that Zimmerman’s visit came on the eve of the 50th anniversary of the March on Washington, which was commemorated Saturday by a civil rights convening that included Tracy Martin and Sybrina Fulton, Trayvon’s parents. The issues of racial profiling, stop and frisk and stand your ground laws are animating a new movement for racial justice, and Martin has become a symbol of the way young black men are treated at the hands of police as well as vigilantes like Zimmerman. “Trayvon Martin was my son, but he’s not just my son, he’s all of our son, and we have to fight for our children,” said Fulton told the crowd.


Yet even in the wake of this, Sybrina Fulton marched in Washington. And she reminded us of what must still be done. She reminded us of the dream that still lives, even amidst her son's tragic death.

Despite the compoinding tragedies and the constant setbacks, the dream still lives. The dream is still here. Do we want it?


Sadly, the radical right's celebration of George Zimmerman's slaying of Trayvon Martin and distortion of Chris Lane's untimely death are clear reminders of the recent setbacks. Yet despite all this, the dream still lives. Can we finally make it a reality?

We Still Have a Dream.

Fifty years ago, he had a dream. Martin Luther King, Jr. let the nation and the world know it was time for change. He played a critical role in advancing civil rights and putting America on a path to equality.



Today is the day to reflect on half a century of progress. However, that's not all.

Today is also the day to realize the progress we must still make. Remember what Rep. John Lewis (D-Georgia) said? Well, he also had something to say yesterday. After all, he was there with Dr. King that day.

There have been many ups and downs in the past half century. We've experienced the sorrow of Trayvon Martin's passing. We've also experienced the triumph of Antoinette Tuff's amazing heroism.

We all have the right to vote, but can we all vote. We all have the freedom to choose, but what are our choices? We all have the right to life, liberty, and the pursuit of happiness, but can we pursue any of it?


Today, we reflect on the past. And we notice the present. And we build a better future. And we never lose sight of the dream.

Fatal Denial

Last week, we discussed two terrible tragedies. In Sandord, Florida, and across the nation, people are still trying to make sense of the George Zimmerman verdict. And closer to home, many in Reno are asking why one of their police officers sold a gun to Jill Schaller's severely mentally ill son.

In recent days, we've seen renewed discussion of gun violence and what we can do to curb it. Even President Obama felt compelled to say something about Trayvon Martin. As we see more and more horrific incidents of extreme gun violence, it's become next to impossible to avoid the subject.

Yet as of now, the G-O-TEA crew in Congress are still trying to avoid the subject. They act as if this isn't a problem. And once again, and they are trying to deny reality.

Yesterday, a few OFA Nevada activists met at "Super Activist" Teresa's house to urge more Nevadans to call our members of Congress.

Senator Dean Heller and Reps. Joe Heck & Mark Amodei can try all they want to deny reality, but reality will soon bite them where it hurts. As we’ve discussed here many times before, the overwhelming majority of Nevadans support expanding background checks for gun gun purchases. This is really the least Congress can do.

Yesterday, the activists at Teresa's house were also asking themselves and each other who may be future "Stand Your Ground" victims. Since the NRA & ALEC successfully made "Stand Your Ground" Florida law, they and their "Tea Party, Inc." allies have been spreading this to other states. Even Nevada now has a limited version of the statute.

Again, the gun lobby and their favorite "TEA" fueled politicians have been trying to deny the frightening reality of rising vigilantism and innocent people being shot dead due to prejudice wrong assumptions "suspicious behavior". How much more of this can we take? Are the extra gun sales truly worth all this unnecessary bloodshed? Has anyone (other than gun manufacturers) actually benefited from the gun lobby calling the shots on state and federal gun laws?

Can Congress afford to deny reality any longer? Can state lawmakers? Can we?

Compounding Tragedies

Nearly three days have passed since the verdict was issued in the George Zimmerman trial. Yet even now, protests in honor of the late Trayvon Martin continue nationwide.

After legendary soul singer Lester Chambers dedicated a song to Trayvon Martin, someone jumped onto the stage and attacked him. Stevie Wonder has already vowed to stop performing in Florida and other "Stand Your Ground" states. And major rallies continue across the nation.

Since Saturday night, we've been forced to pay attention to the intersection of racism and radically flawed gun policies. ALEC, the NRA, and the rest of "Tea Party, Inc." pushed hard for "Stand Your Ground" in Florida and in other states. And as a result, George Zimmerman is a free man again despite admitting he shot Trayvon Martin dead.



This is the brutal reality of our broken gun policies. This is what happens when we allow the likes of the NRA and ALEC to eviscerate even the most basic of gun safety laws. This is what we've come to.

And it's not as if we're immune to this here in Nevada. In fact, we know all too well here in Nevada what happens when "Tea Party, Inc." and the gun lobby get their way. Tragedy occurs. Case in point: the latest scandal to hit the Reno Police Department.

The mentally ill 19-year-old who bought a gun from an on-duty Reno police sergeant was found by a judge last year to have a mental disability, which makes him prohibited from possessing a firearm under state and federal law, a Reno Gazette-Journal investigation found. [...]

Sgt. Laura Conklin did not ask for a background check when she sold the young man the firearm on July 2. Those checks are not required for private party sales under state or federal law.

The case has re-ignited the debate about background checks for private gun sales. The Nevada Legislature argued during the 2013 session about the need for background checks for all sales and passed a measure requiring them, but Gov. Brian Sandoval vetoed the bill, saying it would “erode Nevadans’ Second Amendment rights.”

Adding to the controversy, Washoe District Court clerk Joey Orduna Hasting said late Monday that they made a mistake in their coding system and the man’s case was not sent to the Nevada Department of Public Safety to be included the background check system. That means his name has been missing from the list for more than a year.



Oh, yes. That's right. A Reno police officer actually sold a weapon to someone who wasn't supposed to own it! Apparently, this is the kind of "freedom" that Governor Brian Sandoval (R-NRA) wanted to protect when he vetoed SB 221 last month. And apparently, this is the kind of "freedom" that Senator Dean Heller (R-NRA) felt compelled to protect when he joined the G-O-TEA veto of an even more modest federal background checks bill in April.

These are the consequences we face for inaction on gun safety reform. A police officer can sell a firearm to someone who had already been found unsuitable for firearms ownership. A man can "legally" shoot to death another young man because "he looked suspicious" (read: black). A man can open fire in an elementary school and gun down twenty children & six adults to death. And throughout this state and across this country, many more people can meet their untimely demise. And we can thank the NRA, ALEC, and the rest of "Tea Party, Inc." for these compounding tragedies.

Standing on Bitter Ground

On Saturday, a Florida jury acquitted George Zimmerman for the killing of Trayvon Martin. Since the verdict was announced, protests have broken out nationwide.

Thousands of demonstrators from across the country — chanting, praying and even fighting tears — protested a jury’s decision to clear neighborhood watch volunteer George Zimmerman in the shooting death of an unarmed black teenager while the Justice Department considered whether to file criminal civil rights charges. [...]

The NAACP and protesters called for federal civil rights charges against Zimmerman, who was acquitted Saturday in Martin’s February 2012 shooting death. The Justice Department said it is looking into the case to determine whether federal prosecutors should file criminal civil rights charges now that Zimmerman has been acquitted in the state case. The department opened an investigation into Martin’s death last year but stepped aside to allow the state prosecution to proceed. [...]

In Miami, more than 200 people gathered for a vigil. “You can’t justify murder,” read one poster. Another read “Don’t worry about more riots. Worry about more Zimmermans.” Carol Reitner, 76, of Miami, said she heard about the vigil through an announcement at her church Sunday morning. “I was really devastated. It’s really hard to believe that someone can take the life of someone else and walk out of court free,” she said. [...]

In Philadelphia, about 700 protesters marched from LOVE Park to the Liberty Bell, alternating between chanting Trayvon Martin’s name and “No justice, no peace!”

“We hope this will begin a movement to end discrimination against young black men,” said Johnathan Cooper, one of the protest’s organizers. “And also to empower black people and get them involved in the system.”



A young man was gunned down for walking outside while black. He was carrying Arizona iced tea and Skittles. And he was wearing a hoodie. This is what George Zimmerman found "threatening".

Somehow, a jury of six in Sanford, Florida, found Zimmerman's story possible. So they acquitted him. And protests have since spontaneously emerged nationwide. When is the slaughter of an innocent teenager justified?

That's what continues to be asked in Florida and nationwide. When did the victim become the suspect? When did racial profiling become "public safety"? Why is this happening?

Not only have the NRA, ALEC, and the rest of "Tea Party, Inc." succeeded in recent years in making so many dangerous weapons readily accessible (even to criminals), but they have also passed "Stand Your Ground" laws across the country (including a limited version here in Nevada) that encourage the very vigilantism that George Zimmerman engaged in. And on top of that, these "Stand Your Ground" laws allow vigilantes like Zimmerman to walk away free after shooting innocent people.

So where do we go from here? What happened over the weekend served as a stark reminder of the many loopholes in our gun laws... And of the long road ahead to remedy continuing racial discrimination across this country.

Here's a Novel Concept: Don't Blame Any More Victims.

On Wednesday, Ammar Harris had his day in court here in Nevada. He's charged with murder in the Las Vegas Strip shooting and car crash this past Feburary. After weeks of fighting extradition from California, Harris was finally brought back to Nevada to go to trial.

Now remember, Ammar Harris is on trial for murder. Yet in the first week after the shooting, some were quick to point fingers at Kenneth Cherry, one of the VICTIMS in that attack. "Oh, but he was a pimp. He was a gangster. He was asking for it!" We heard excuses for Cherry's untimely death, and it forced his family to step forward to remind everyone that he was a slain victim, not a criminal.

What made this case even more poignant was that it was happening around the time of the one year anniversary of the murder of Trayvon Martin in Sanford, Florida. There, George Zimmerman claimed he shot Trayvon Martin dead because he looked "threatening". He was walking home while carrying a bag of Skittles & a bottle of iced tea when Zimmerman shot him dead.

Even though Trayvon Martin was the victim, he posthumously faced allegations of criminal wrongdoing. A Florida police chief even used Trayvon's photo for "target practice". And remember, he was killed for wearing a hoodie while walking home with a bag of Skittles and a bottle of iced tea.

Yesterday, Trayvon Martin's parents sent a special message to the parents of Martin Richard, the 8 year old boy who was killed in the Boston Marathon Attack on Monday. He was watching his father finish the marathon when he was caught in the bomb blast.

The parents of Trayvon Martin, the teen shot and killed by neighborhood watchman George Zimmerman in 2012, have sent a message to the family of the 8-year-old boy who was killed in the Boston Marathon explosions.

Martin Richard, 8, was pictured on Facebook holding a peace sign created in response to a lesson by his teacher about the death of 17-year-old Trayvon Martin, which prompted the parents of Trayvon Martin to send a special message to the family of Martin Richard.

The statement released on Tuesday reads as follows:

"Our hearts are broken over the tragedy in Boston yesterday. Our family sends our sincerest condolences to all of those who have been affected by this terrible situation. We especially would like to send a message to the family of eight year old, Martin Richard. We have come to understand that the peace sign that Martin is holding in a photo being circulated throughout the media, was created in response to a lesson by his teacher about the death of our son. From our family to yours', we are praying for you, thinking about you and will remember your son for the rest of our lives."

This moved me to tears when I first read it this morning. Sadly, so did this. After facing a full media swarm descend upon his house, Ruslan Tsarni strongly condemned his nephews for their likely role in the Boston Marathon Attack.



Apparently, I wasn't alone. Joan Walsh was thinking about the same thing. It's the dark underbelly of American culture that always emerges after a tragedy like this one.

Tsarni’s rant wasn’t exactly what law enforcement might have advised: A soothing person giving young Dzhokhar a reason to come out of his hiding place alive,and to cooperate with officials in revealing whether there may be more hidden bombs as well as what his and his late brother Tamerlan’s motives were.

But it was a window on an ancient American story: the anguish of immigrants when one of their own becomes notorious, and shames not only his family, but his entire ethnic group.

“He put a shame on the Tsarni family. He put a shame on the entire Chechen ethnicity,” the uncle raged. “It has nothing to do with Chechnya.” To reporters questions, he answered: “We’re Muslims, we’re ethnic Chechens,” and he went on: “Of course we’re ashamed. They’re children of my brother. Who had little influence of them.” [...]

Tsarni’s anguished press conference (video below) was a live, televised twist on an old American narrative: an immigrant struggling not to have his people defined by the bad behavior of one of the group. Generations of American immigrants not only Americanized their names to seem less foreign; they cringed whenever one of their group “shamed” them with notorious criminal behavior.

Irish Americans ashamed of the poverty, destitution and sometimes notorious behavior of famine Irish refugees in the mid-19th century dropped the “Mc” or the “O” from their names. Even as a second generation Irish Catholic on Long Island in the 1960s and ’70s, I was schooled in not seeming “shanty Irish,” which mainly involved not yelling out the window at friends or my family, not serving food directly from the pot to the table, and keeping my fingernails clean. Our Italian neighbors shuddered at the high-profile Mafia escapades of the era. [...]

The rabid anti-Muslim prejudice in the U.S. since 9/11 provides new reasons for any Muslim who finds a family member accused of a crime. Tsarni expressed solidarity with the families of Boston bombing victims. “We’re sharing them with their grief. I’m ready to just bend in front of them, kneel in front of them, seeking their forgiveness, in the name of the family.”

I'll add that this isn't even limited to immigrants. As mentioned above, the families of Trayvon Martin and Kenneth Cherry have had to clear their names in the media... Despite the fact that they were the victims!

Still, this has allowed the "tea party" to throw a giant, xenophobic monkey wrench into the pursuit of comprehensive immigration reform (CIR) in Congress. Following Reps. Steve King's (R-Iowa) & Louie Gohmert's (R-Texas) respective nonsensical & unhinged attempts to tie the Boston Attack to the Gang of 8 CIR bill, fellow "tea party" icon Ann Coulter chimed in with another insensitive, nonsensical, and unhinged rant. This has even forced Senator Marco Rubio (R-Florida) to beg his fellow Republicans not to engage in any more mindless speculation that only results in more xenophobia and more trouble. Unfortunately for Rubio, his request seems to be falling on deaf ears.

Sen. Chuck Grassley (R-IA) raised the topic early in the hearing, which was supposed to feature Homeland Security Secretary Janet Napolitano before she was forced to cancel her appearance due to the ongoing response to the attack.

"Given the events of this week, it’s important for us to understand the gaps and loopholes in our immigration system," Grassley said, according to the Huffington Post. "While we don’t yet know the immigration status of the people who have terrorized the communities in Massachusetts, when we find out, it will help shed light on the weaknesses of our system."

Sen. Chuck Schumer (D-NY), one of the sponsors of the immigration bill, said that he will work with DHS on any immigration issues that emerge from the bombing. But he warned that his colleagues should not rush to tie it to reform legislation given the lack of available information.

"I'd like to ask that all of us not jump to conclusions regarding events in Boston or conflate those events with this legislation," Schumer said. "In general, we're a safer country when law enforcement knows who is here, has their fingerprints, photos, etcetera, conducted background checks ... Two days ago, as you may recall, there was widespread erroneous reports of arrests being made. This just emphasizes how important it is to allow the actual facts to come out before jumping to any conclusions."

Actually, we know the two named suspects had been living in America for over a decade. And the one who was shot dead this morning had become a permanent legal resident in 2007. But of course, that won't stop the "tea party" from trying to take advantage of this tragedy and (mis)use it to shoot down comprehensive immigration reform.

And herein lies the problem. We're all too often to react to tragedy with prejudice, and that prejudice only serves to hamper efforts to recover. We saw this earlier in the week as some "internet detectives" and media sensationalists were falsely accusing people of Monday's attack. But now that we know the names of two suspects (and one of them has already sided in a shootout with police), the same media senationalists are already jumping to wrong conclusions again as family members of the suspects have had to issue condemnations to quell any backlash against Muslims and ethnic Chechens.

Certainly, it looks increasingly like these suspects committed a very heinous crime and hurt many innocent people. However, their uncle and aunt are not to blame. Neither are other Chechen Americans living peacefully in this country. And neither are the many Muslim Americans who live peacefully in this country, just like the rest of us.

Yet again, a vicious cycle of bigotry and xenophobia is playing out. We can only hope enough people speak against this nonsense and debunk the madness before it causes any more problems. Haven't we seen enough victims hurt this week?

Victims, Guilt, & Guns

A manhunt is now underway for Ammar Harris, the lead suspect for the Las Vegas Strip shooting last week. Another person of interest is also being sought. The search for Harris is now nationwide.



Police believe an altercation at Aria led to the shooting. Yet despite this, there's been media speculation about victim Kenneth Cherry and his personal life. "Oh, he was a pimp! It was all just a pimp war." (Never mind that Cherry was never arrested for any crime, and that he's one of the slain victims in this crime.)

It's not as if this hasn't happened before. Still, it's disturbing to see certain victims of gun violence villainized in some corners of the media and treated like perpetrators. Why go there?

Yesterday was the one year anniversary of the fatal shooting of Trayvon Martin near Orlando, Florida. Even though he was the slain victim, some in the media were ready to villainize Trayvon. Why? He was wearing a hoodie!



The NRA pushed hard for Florida's "Stand Your Ground" law, the statute that George Zimmerman now uses to justify the murder of Trayvon. The NRA & ALEC then pushed more states to pass similar "Stand Your Ground" law. Even Nevada now has a modified version of it.

For decades, the NRA has (mis)used its juice in Carson City and Washington to weaken gun safety standards. They've essentially bribed lawmakers in the not-so-distant past with campaign contributions and prestigious "A" ratings. Meanwhile, victims of gun violence were all too often marginalized, forgotten... And in some cases, even treated like criminals.

Last night in Illinois, we saw a groundbreaking development. As mentioned above, the NRA has enjoyed immense political clout. But now, that's being called into question as former Illinois state legislator Robin Kelly won the Democratic Primary for the 2nd Congressional District spreading from Chicago's South Side to exurban Kankakee County.

Kelly ran against Debbie Halvorson, herself a former Member of Congress who lost her old seat in 2010. Because she had some name recognition from that and challenging Jesse Jackson, Jr., in this seat before he resigned, she was considered the early frontrunner. But in the wake of Newtown and increased gun violence right in Chicago, this special election to replace Jackson became a referendum on the NRA. And the gun lobby hasn't been used to taking criticism on the campaign trail.

To be sure, this is a heavily Democratic district, and messages that resonated in Illinois' 2nd district may not be equally as effective elsewhere. But that doesn't negate the fact that this was the first race in recent memory in which a major party's candidates felt the need to distance themselves from the NRA. The far-right lobbying group's "A" ratings for some of the candidates practically became "a scarlet letter," forcing some Democrats who'd previously bragged about NRA support to scramble in the other direction.

Even in reliably "blue" districts, that just hasn't happened in recent years. Democrats, at nearly every level, had been led to believe that supporting gun control was a recipe for electoral failure, so they reflexively avoided the issue. This race set out to challenge those assumptions, and the results were unambiguous.

Indeed, Kelly was only too pleased to tout her "F" rating from the organization, which in turn led to support from Bloomberg and progressive groups like the CREDO super PAC. It helped separate her from the pack and positioned her to become a member of Congress in April.

And because of this, Capitol Hill must rethink its relationship with the gun lobby. And in fact, it will have a chance to do so today as the Senate Judiciary Committee finally gives the Assault Weapons Ban a hearing. The gun lobby has attempted to blithely dismiss calls for gun safety reform as "The Connecticut Effect", but that strategy may not be so effective any more.

We've just seen too many untimely, unnecessary, and uncivilized deaths across the country. From Tucson to Sanford, and from Newtown to Las Vegas, the shootings have piled up. And the gun lobby's excuses are wearing thin.


Driving down Las Vegas Boulevard is not a crime. Wearing a hoodie outside is not a crime. And for goodness sake, going to school is not a crime. But you know what? Murder is. And while protecting criminals' right to murder, it can be just as dangerous and dastardly.

There's been growing suspicion both of shooter George Zimmerman and his motives for killing Trayvon, as well as of Florida's "Stand Your Ground" Law, and just how much that contributed to Trayvon's untimely death.

Yesterday, The Sun asked: Can it happen here?

In Las Vegas, officials and academics are taking a close look at the Martin case, and for good reason: Nevada recently passed a law nearly identical to Florida’s, leading many to believe a similar tragedy could play out in the Silver State.

“The circumstances are ripe for a Trayvon situation to happen here,” said Sylvia Lazos, a law professor at UNLV's Boyd School of Law. “We have a lot of crime. We have a lot of people with guns. We have a lot of people who are untrained. We have to watch it. ... These combinations can be quite toxic.”

Nevada is one of 25 states, according to the Legal Community Against Violence, with a law allowing individuals to use deadly force when they feel threatened with no obligation to stand down or try to avoid violence once reasonable fear is established.

Nevada’s “stand your ground” law was approved by the 2011 Legislature and took effect in October. It allows that as long as a person who feels threatened didn’t initiate the altercation and isn’t doing anything criminal, that person can stand and use deadly force and it would be considered “justifiable homicide.”

Such laws “are all designed to allow for some expanded notion of self-defense,” Lazos said. “The problem that you have when regular people engage in self-defense ... is that people make decisions fairly quickly about whether they are, in fact, in danger.”

Last year, our Legislature passed AB 321, which was a somewhat modified version of "Stand Your Ground" that formalized the already accepted view (in this state) that people can shoot to kill if they feel their lives and/or property is at stake. While AB 321 may "feel good" in that it supposedly empowers potential crime victims to "stop a crime before it starts" (along with providing politicians who support it with plenty of praise from the NRA), it may soon lead to some frightening unintended consequences. Case in point: Trayvon Martin.

Last session, all but three Nevada legislators (for both houses COMBINED!) voted for AB 321. Assembly Members Maggie Carlton (D-East Las Vegas), Richard Carrillo (D-Paradise), and Peggy Pierce (D-Las Vegas) were the only ones to vote against AB 321, while all their Assembly colleagues either sponsored or co-sponsored this bill in addition to voting for it. The Senate passed AB 321 unanimously. Sadly here in Nevada, "trigger happy" on steroids can be prevalent in both parties, and it especially reoccurs when NRA and other gun lobby endorsements are at stake.

So far, there's been no hard evidence proving George Zimmerman was in danger of losing his life or any of his property when he spotted Trayvon Martin in his gated community. However that didn't stop certain folks in law enforcement from letting George Zimmerman go without charging him for homicide, simply because Zimmerman's lawyers claimed "Stand Your Ground" as his defense. There's a good chance we can see cases like this occur here in Nevada thanks to AB 321.

And frankly, that's why state statutes like Nevada's AB 321 and Florida's "Stand Your Ground" Law frighten me. They set up a dangerous slippery slope for justifying as "self-defense" what would otherwise be declared manslaughter or murder. After all, what we may consider murder can be twisted by a smart criminal defense attorney into a "Stand Your Ground" situation just by insinuating that the homicide victim was somehow threatening the shooter's life and/or property, even if there's little or no evidence that the shooter was really at risk.

So why are we now falling down this slippery slope? Why did we have to take this downhill course in the first place? And can we afford to keep making decisions out of political convenience while ignoring future public safety crises?
